TERMS AND CONDITIONS OF USE
1. PURPOSE
These General Conditions of Use regulate the use of the IBtaxi and taxistesIB applications (hereinafter, the “App”), owned by the Govern de les Illes Balears (hereinafter, “the Govern”).
By accessing and using this application, you acknowledge that you have read and accepted these General Conditions of Use and agree to comply with all its terms and conditions, establishing a contractual relationship between you and the Govern.
The Govern reserves the right to modify these General Conditions of Use at any time, as well as any other applicable general or specific conditions. Modifications shall not, under any circumstances, affect services provided prior to their approval, which shall be governed by the conditions in force at the time the service was rendered. The user shall be deemed to have accepted the changes by accessing the application again following any such modification.
The user is responsible for being aware of the General Conditions of Use in force at the time of starting a booking process. Furthermore, the Govern reserves the right to suspend, halt, or cease operation of the application at any time.
The electronic document used to formalize the contract regulating the commercial relationship between the Govern and each of its users will be archived by the Govern and may be consulted via the application following authentication with a username and password, or by any other established means. A paper copy may also be requested from the Citizen Service Department via email at atencio.ciutada@caib.es.
2. USER REGISTRATION
To facilitate the use of services offered through the application and to avoid requesting the same data for every use, it is necessary to register as a user.
A “user” is defined as any person accessing the application to create an account and request or offer services, encompassing passengers, drivers, and taxi license owners (hereinafter, the “User”). Upon completion of the registration process, you will receive a confirmation. Registration can be performed at any time, once only, is free of charge, and is not subject to any conditions or compensation.
Users may access their accounts with their username and password or any other authentication method provided by the Govern. The profile will contain relevant information such as previous services performed, accepted bookings, etc.
Users may contract the services offered through the application if they are of legal age. Otherwise, parents or legal guardians must guarantee compliance with this provision, as they are responsible for the actions of minors.
To unsubscribe, the user may delete their account via their user profile or send an email to IBtaxisuport@dgmobil.caib.es. The Govern reserves the right to manage user registrations and cancellations.
Cancellation of the user subscription will imply the deletion of personal data and the inability to make online bookings and purchases in the future until the user registers again.
3. OPERATION OF THE APPLICATION
3.1. Purpose of the Service
Through the application, the Govern offers the user access to available transport services in real time. Depending on the type of service and coverage area, the App may allow for the booking of transport services in real time or in advance.
The user shall use the application to indicate the starting point and destination of the trip, the number of passengers, and, if applicable, special requests such as wheelchair-accessible vehicles (PRM), pets, or baby seats. To do so, users must authorize the sharing of their location. The application will propose a pick-up and drop-off point, which may not coincide exactly with the user’s preferences but will be a nearby location adjusted to the service. An estimated schedule and approximate fare for the trip will also be provided.
3.2. Acceptance or Rejection of the Booking Proposal
Once the date, time, origin, and destination proposed by the App have been selected, the user may accept or reject the trip proposal at no cost. A booking does not imply a commitment to the specific vehicle used, nor does it indicate the exact route of the vehicle.
3.3. Modification of the Route
The Govern is not obliged to indicate the exact route of the vehicle, as this may change according to service operations.
Once the proposal is accepted, the user may not modify the itinerary or the agreed pick-up and drop-off points. During the journey, the user may not request changes to the itinerary from the driver, although they may request to exit the vehicle at any time without the right to a full or partial refund of the fare.
4. USER OBLIGATIONS
4.1. Passenger and Driver Conduct
The passenger must be at the pick-up point at the indicated time and is responsible for identifying the correct vehicle. Conversely, the driver must provide the service at the pick-up point at the indicated time and is responsible for identifying the user who requested the service.
During the journey, the user must maintain appropriate conduct without distracting the driver or disturbing other passengers. If the user fails to comply with these conditions, the driver may require them to leave the vehicle.
If the passenger does not appear at the agreed time, the driver is not obliged to wait or provide the service.
4.2. Prohibited Uses
Users shall be solely responsible for the improper use of the application, including but not limited to:
- Registering on behalf of another person or impersonating third parties.
- Publishing images or personal information of third parties without their consent.
- Using the application in an illegal manner or in a way that is detrimental to the image of the Govern.
- Creating false identities or providing false data.
5. LIABILITY AND SANCTIONS
5.1. False Information
The user is responsible for the veracity of the information provided in the application. The Govern is not responsible for the falsity of data relating to third-party service providers.
5.2. Cancellation Policy and Service Suspension
The user may cancel a booking before its execution, but this may be subject to a penalty according to the specific conditions of the service.
If the user does not appear or breaches any rule, the Govern reserves the right to block their access to the application for a specified period or to cancel their account.
5.3. Limitation of Liability
The Govern is not responsible for the provision of the transport service itself; its role is limited to providing the platform for booking trips with operators. Consequently, the user exonerates the Govern from any liability derived from the transport service.
The Govern is not responsible for data security on third-party payment platforms or for any unauthorized use of banking data.
5.4. Force Majeure
The Govern does not guarantee exact compliance with pick-up and drop-off times due to potential external incidents such as traffic, strikes, or accidents, among others.
6. APPLICABLE LEGISLATION
This contract is governed by Spanish legislation, including but not limited to:
- Law 34/2002 on Information Society Services and Electronic Commerce.

All final prices are expressed in Euros (€) and include VAT (Value Added Tax).
The Govern only provides the platform; therefore, the user’s payment will be made to the provider rendering the service—namely, the carrier.
The Govern reserves the right, at any time and without prior notice, to make appropriate modifications to the application, including updating price scales.

In accordance with Organic Law 15/1999 of December 13 on the Protection of Personal Data and the General Data Protection Regulation (GDPR), the Govern informs that personal data collected during the online booking process will be incorporated into a file owned by the Govern for the purpose of providing the acquired services, as well as for promotional purposes.
To book trips online, the user must voluntarily and at their own risk provide personal data, which must be truthful and accurate. The user formalizing the online purchase process declares that they are the owner of the information provided or, failing that, that they are authorized by the person in whose name the transaction is performed.
Once registration is formalized, the Govern guarantees that it will treat the personal data obtained through the relevant form, as well as all data corresponding to the payment method used, in a completely secure and confidential manner, in compliance with Spanish regulations governing data protection.
Furthermore, by signing this document, you expressly authorize the Govern to transfer your personal data to the operators and drivers of the service for the provision of the contracted service.

11. COMMUNICATIONS
For the purposes of these General Conditions and for any other necessary communication between the Govern and the user, such communications must be made by sending an email to IBtaxisuport@dgmobil.caib.es.
Communications from the Govern to the user will be made according to the data provided in the application.
12. SEVERABILITY AND TERMINATION
In the event that any of the clauses of these General Conditions of the contract are declared null, subject to termination, illegal, or unlawful, applying the broadest interpretation permitted by law: (a) such finding shall not invalidate the remainder of the contract, which shall remain in full force and effect, and (b) the null or terminable clause(s) shall be replaced or modified in preference to being declared void.
13. APPLICABLE LAW AND JURISDICTION
These General Conditions shall be governed by and interpreted in accordance with Spanish legislation for everything not expressly provided for herein. The parties expressly waive any other forum that might correspond to them and submit, except in those cases prohibited by law, to the jurisdiction and competence of the Courts and Tribunals of the city of Palma (Spain) for the resolution of any issue that may arise regarding the same.
14. INTELLECTUAL AND INDUSTRIAL PROPERTY
The Govern is the owner of all industrial and intellectual property rights relating to the content of the IB TAXI application.
Through these Conditions, the Govern, as the owner of the application, prohibits any form of reproduction, distribution, public communication, and, in general, any act of exploitation of all or part of the contents (images, texts, designs, indexes, forms, videos, etc.) that make up the application, as well as the databases and software necessary for its visualization and operation, without the express prior written authorization of the Govern.
Furthermore, the user may not, under any circumstances, exploit or use for commercial purposes, directly or indirectly, in whole or in part, any of the contents of the Govern’s application without written authorization. If the user violates this license, the Govern will cancel their user registration, without prejudice to any other claims it may exercise as a result of damages incurred due to said violation.
The total or partial reproduction of the Govern’s content and its offers and promotions is strictly prohibited without express written consent. Unauthorized use of these contents will give rise to legally established liabilities.
The Govern is not responsible for infractions committed by users of its mobile application that affect third parties. Provided that all existing security measures have been adopted in accordance with its technical capabilities, the Govern is not responsible for possible attacks by “hackers” or third parties specialized in breaching the security or integrity of information systems.
